Finalising an Education, Health and Care Plan (EHCP)

Following EHC Needs Assessment, if it is agreed that an Education, Health and Care Plan (EHCP) should be issued, the LA will draft and issue a proposed EHCP.

You will have 15 days to review the draft EHCP. During this time you can:

  • request any amendments to the content, linked to the advice received as part of the assessment process
  • request that a particular school, college or other educational institution is named in Section I of the EHCP

It is strongly recommended that parents/carers visit schools or education settings they may wish their child to attend prior to requesting that they are consulted for a place.

At this stage you can request a Personal Budget.

Consultations with educational settings

The Council must consult the school, college or educational institution which is parental preference. We may also consult other settings we believe may be appropriate for your child. Settings must respond within 15 days of consultation to state whether they can meet the child’s needs and offer them a place.

The final EHCP

Once the Council has consulted with you and your child about the draft EHCP, it must finalise the EHCP.

Once the EHCP is finalised you will receive a copy. A copy will be sent to the school or setting which is named in Section I.

Once a setting has been named in the EHCP, it must admit your child and put the educational provision in the Plan into place.
